Typical requirements for room dividers or accent partitions?

Is it typical for the same codes that govern spacing between stairrail balusters to be applied to room dividers?

I've been asked to bid a wall of birch logs similar to the attached picture. Has anyone here done one of these?

I've located a couple reputable sources for birch logs that have been appropriately sourced. But without having the material on hand, I'm concerned that logs that wander may create unpredictably large gaps between poles. Is this a valid concern from an inspection standpoint?

Being risk-averse by nature, I'd probably lean toward spacing the poles more closely if the logs I get are less than straight, but I'd like to buy the material once and not run out...

Kids get their heads stuck in between things all the time. If the child has his head stuck and then passes out from the restriction, you will have a death related lawsuit on your hands. I'd worry more about the possible consequences than the legality of it. Also to be considered is bringing in insects that bore under the bark of trees, especially standing dead trees. If you want to handle the liability issue, make sure those birch trees are kiln dried to sterilize them.

RichC, Fair point, you are absolutely correct. Like I said, I'm risk averse. But legality inevitably comes into play if the poles wander from straight: If there is a 4.25" gap at 7'6" off the ground, where no human 2 year-old could reach, then I'm not worried about it, unless and inspector might demand my work be ripped out 2 years down the road. So that's my question.

Thanks for bringing up the bugs, my suppliers are certified to ship across state lines, so I assume these poles would have to be kiln-dried, but I will double check!
